Terms of Service

These Terms govern your access to and use of Expansively.

Important: This is a practical terms draft for Expansively and should be reviewed by qualified legal counsel before broad public launch.

1. Agreement to these Terms

By creating an account, accessing, or using Expansively (the “Service”), you agree to these Terms of Service and our Privacy Policy and Community Guidelines. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old, or the higher minimum age required where you live, and legally able to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind it.

3. Accounts and security

You must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless caused by our failure to use reasonable security measures.

You may not sell, transfer, or impersonate another person’s account. We may require verification to protect an account or complete certain requests.

4. Your content

You retain ownership of content you submit. You grant Expansively a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt for technical purposes, distribute, and otherwise use that content only as needed to operate, improve, promote, and protect the Service.

You represent that you have the rights needed to submit your content and that it does not violate law, another person’s rights, or our rules. You can remove content through available features, subject to technical backups and records retained for safety or legal reasons.

5. Acceptable use

You must follow our Community Guidelines. You may not misuse the Service, interfere with its operation, access it through unauthorized methods, scrape or automate activity without permission, distribute malware, commit fraud, or use the Service for unlawful conduct.

6. User-created events and services

Users may create events, listings, appointments, and services. Unless expressly stated otherwise, Expansively is not the organizer, employer, agent, insurer, or contracting party for those activities. Users are responsible for evaluating other users, descriptions, prices, safety, legality, licensing, cancellations, and any agreement they make with each other.

Expansively does not guarantee attendance, quality, availability, suitability, identity, or outcomes.

7. Third-party services

The Service may link to or use third-party services. Their terms and privacy policies govern their services. Expansively is not responsible for third-party content or practices.

8. Safety and moderation

We may investigate reports and remove content, limit distribution, warn users, suspend accounts, ban accounts, or take other reasonable action to enforce these Terms and protect the community. We are not required to monitor every interaction and cannot guarantee that all objectionable material will be identified immediately.

9. Expansively property

The Service, branding, software, designs, and other materials provided by Expansively are owned by Expansively or its licensors and are protected by applicable law. These Terms do not transfer ownership to you.

10. Suspension, termination, and account deletion

You may stop using the Service at any time and may delete your account through Account Settings. We may suspend or terminate access when reasonably necessary for safety, legal compliance, nonpayment where applicable, repeated violations, or material breach of these Terms.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, error-free operation, or the conduct of users.

12. Limitation of liability

To the maximum extent permitted by law, Expansively and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from use of the Service. Where liability cannot be excluded, it will be limited to the greater of the amount you paid Expansively during the 12 months before the claim or US $100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend and indemnify Expansively from claims arising from your content, your misuse of the Service, or your violation of these Terms or another person’s rights.

14. Governing law

These Terms are governed by the laws of the State of New York, excluding conflict-of-law principles, except where mandatory consumer law provides otherwise. Any dispute not subject to a mandatory alternative process will be brought in a court of competent jurisdiction in New York.

15. Changes

We may update these Terms. We will post the updated version, change the effective date, and provide additional notice when required. Continued use after the effective date means you accept the updated Terms.
